On the 16th of May 2007, two doctor friends of the McCanns, and
the Paynes, make a statement to Leicestershire Police (LP) in which they express their concern over sexually suggestive gestures
made by David Payne on a previous holiday in Majorca. These alleged gestures are considered, by one of the witnesses, to be
consistent with acts of paedophilia.
The statements are not sent from LP to the Policia Judiciária (PJ)
until 24 October 2007 (arriving on 26 October 2007), 24 days after Gonçalo Amaral had been removed from the
In an interview with Correio da Manhã, published on 24 July 2008, Gonçalo Amaral states
that the depositions arrived in May, but this refers to the date they arrived at LP.
Intriguingly, the letter from
LP mentions the completion of a written questionnaire - by David and Fiona Payne - but it is unclear whether that questionnaire
was supplied by the PJ or whether it was instigated by LP themselves. There appears to be no copy of the questionnaire anywhere
in the PJ files.
Correio da Manhã reports, on 19 July 2008, that 'the depositions ... only entered the
process in January 2008 ... At that point in time, Kate and Gerry were already arguidos, the rogatory letters had already
been issued and the English, including Dave, showed their reluctance in returning to Portugal.' However, this statement,
about the depositions only entering the process in January 2008, does not appear to be supported by the PJ files themselves.
It is unknown whether these statements by the Gaspars were subject to any further follow-up by either LP or the PJ.
Also on this page are the statements of Yvone Martin who expressed concerns about David Payne and the behaviour of
the McCanns. It is understood these statements were followed up by Gonçalo Amaral, who notes in his book, 'The
Truth of the Lie', that Leicestershire Police reported: "There is nothing incriminating in his past and, as we were
able to verify, he has no criminal record."

I give this
declaration in relation to the MCCANN family who are currently in Portugal. The MCCANN family is composed of Gerry MCCANN,
his wife, Kate MCCANN and their three children, Madeleine, age 4, and Sean and Amelie, who are twins and of 2 years of age.
As it is widely divulged, Madeleine is not with her family presently, and has been missing for the last two weeks.
I will begin by explaining that I am married to Savio Gaspar and that we have two daughters, E*****, who is almost
3 and I***** who is now one year old. I have been married to Savio for 11 years. I am a general practitioner like my husband.
I met my husband when we were (page 1) working together in Exeter, around 14 years ago.
To explain in what way
we met the MCCANN family, I would like to state that my husband knows Kate, given that both attended Dundee University between
1987 and 1992. At that time, Kate's name was Kate HEALY. I met Kate and Gerry for the occasion of their wedding, around
1998, in Liverpool. Both Savio and I went to the wedding because since Savio was an old friend of Kate, we were both invited
to the event.
As far as I know Savio did not know Gerry before the abovementioned wedding. After that time, we
met as friends and about three times we spent weekends away together. I would say become close to be intimate friends of Gerry
I remember that in 2002 or 2003, Savio and I spent a weekend with Gerry and Kate in Devon. We maintained
contact with each others via phone.
In 2002/2003 Savio and I were living in Birmingham and the MCCANNS in Leicester.
In September of 2005, Savio, I and Ellena, who at the time was 1 and a half years old, spent our holidays abroad,
in Majorca. We went (page 2) on holidays with Kate, Gerry, and Madeleine, who should have been around 2 and a half years old
and with the twins, Sean and Amelie, who were just months old. I remember that I was pregnant with Isabella.
those holidays, with us, were as well friends of Gerry and Kate.
There was a couple, whose names were Dave and
Fiona, and whose family name was PAYNE, I believe. I think that they were married and had one daughter with about 1 year old,
named Lilly. I remember that on those holidays, Fiona was pregnant.
There was another couple, whose names were
Tara and Stuart, and whose family name I cannot remember who were also on holidays with us. They had two boys, of 1 and 3
years old, whose names I do not remember. I did not know these two families until we went on holidays together. From memory,
I think that it was David who organised these holidays and we all stayed together in a big house in Majorca.
spent a week on holidays, however, the MCCANN family and the PAYNE family stayed for two weeks. I think that Tara and Stuart,
and their two children, also stayed for just one week.
Two or three days had gone by, all of us staying in Majorca
where, in general terms, we had fun (Page 3) with our children. Possibly around the fourth or fifth day abroad, I remember
an incident that stayed recorded in my head. I say this in this way, because I have thought many times about the incident
that I am about to describe.
One night, on holidays, the adults, that is, the couples that I mentioned, were on
a patio outside of the house where we were staying. We had been eating and drinking.
I was seated between Dave
and Gerry who I believe were both speaking about Madeleine. I don't remember the conversation in its entirety, but it
seemed they were discussing a possible scenario. I remember Dave telling Gerry something like "she", referring to
Madeleine, "would do this".
When he mentioned "this", Dave was sucking on one of his fingers,
pushing it inside and outside his mouth, while with the other hand he made a circle around his nipple, in a circulatory movement
over his clothes. This was done in a provocative manner and carried an explicit insinuation in relation to what he was saying
I remember that I was shocked at this, and looked at Gerry, and also at Dave, to see their reactions.
I looked around (page 4) as if saying "did anyone else hear this, or was it just me". There was a nervous silence
registered in all the conversations and afterwards, everyone began talking again.
I never spoke to anyone about
this, but I always felt that it was very strange and it wasn’t something that someone should do or say.
this [incident], I remember that Dave did the same thing once again. When I refer to this, I want to clarify that it was during
a conversation in which he was talking about an imaginary situation, though I could not say exactly what about. I believe
that he was talking about his own daughter, Lily, though I'm not certain. He put one of his fingers in his mouth and slide
it in and out, while the other hand drew a circle around his nipple in a provocative and sexual manner. I believe that he
was referring to the way that Lily, would behave or do it.
I believe that he did this later on, during the holidays,
but I cannot be sure. The only time, besides this one, that I was with Dave and Fiona was several weeks after the holidays,
when Savio and I met up with Gerry, Kate, Dave and Fiona at a restaurant in Leicester.
I am absolutely certain
that he said what he said and that he did the gestures that I referred, but that could have occurred in the restaurant in
Leicester, though (page five) I believe that it was later on, in Majorca. When I heard Dave doing and making this a second
time, I took it more seriously.
I remember thinking whether he looked at the girls in a manner different from me
or from the others. I imagined that maybe he had visited Internet sites related to small children. In short, I thought that
he was interested child pornography on the internet.
During our holidays I was more attentive at bath time after
hearing Dave saying that.
During our vacation in Majorca, it was the fathers who took care of the children's
baths. I had the tendency to walk close to the bathroom, if it was Dave bathing the children. I remember telling Savio to
be careful and to be there, in case it was Dave helping to bathe the children and, in particular, to my daughter E*****. I
was very clear about this, as having heard him saying that had disturbed me, and I did not trust him to give bath to E*****
When I heard Dave say that a second time, it reinforced what I already thought in relation to his thoughts
about girls. During our stay in Majorca, Dave and his wife, Fiona, accompanied by this daughter Lily, took Madeleine (page
6) with them to spend the day, in order to give Kate and Gerry a bit of rest and time to be with the twins. When I say this,
it is not that I was worried about Madeleine's safety, since she was also with Fiona and Lily, and also with Dave, as
far as I know.
As I already mentioned, I was only with Dave and Fiona on one occasion, after Majorca, and I have
not spoken to them since that time. In the last two years, we have met, as a family, with the MCCANN, once in a while. That
happens mainly at the children's birthdays, a time when we get together.
The first time I had knowledge of
the terrible news about Madeleine's disappearance through the radio, my thoughts went immediately to Dave. I asked Savio
if Dave was also on holidays with the MCCANN in Portugal but he did not know.
I watched TV meticulously, and watching
the coverage of the news, I understood that Dave was there, because I saw him, in the background, on the television images
during the first days after the Madeleine's disappearance. Based on that, I believed that he was on holidays with the
MCCANN in Portugal. Today, Wednesday, the 16th of May of 2007, at 17:40, I gave DC Brewer an A4 page containing 2 photographic
images. I am going to reference these images as (ref KZG/1) (probatory element) that may (page seven) be presented as mean
of proof, if necessary. These photographs were taken during the holidays in Majorca. In the photographs, Dave is wearing a
white t-shirt and the woman in the photograph corresponds to his wife Fiona. The man who is holding the glass of wine in the
photograph is Stuart. These photographs were taken while we were at Majorca.

This statement was made in relation to the disappearance of Madeleine McCann.
I currently work as
a GP at XXX, XXX, where I have been employed for the last nine years.
Madeleine is the daughter of Kate and Gerry
McCann and we are friends of the family.
I have known Kate since 1987, when we met at Dundee Medical School, and
became friends. We have remained in touch all this time and meet up 3 or 4 times a year, we often talk on the phone or email
When we first became friends in 1987 she was still known as Kate Healy, this was the case until she
married Gerry at the end of 1990s. Kate and I completed our medical degrees in 1992, when we each carried on with our lives,
once we had begun our careers.
After I finished my degree I began my career in Exeter, and I think Kate went to
I only met up with Kate again in 1997 or 1998. At that moment I was married to Katherina, we had both
been invited to attend Kate and Gerry's wedding.
After their wedding we lost contact and I think they went
to New Zealand.
We only met up again in 2001 in Birmingham.
The couple visited us in the house where
we then living, in Athingys Green, and this was the first time I talked to Gerry.
I think that at the time Kate
and Gerry were living in Queeniborough, Leicestershire.
From 2001 and 2005 we were in regular contact and often
visited each other's homes.
We planned holidays for the first week of September 2005 in Majorca, Spain, together
with three other couples including Kate and Gerry. We did not know the other two couples, they were friends of Kate and Gerry's,
we had never met them before.
We all had children.
When we went on this holiday we had one daughter,
E***** aged 18 months.
Kate and Gerry had 3 children, Madeleine almost two and the twins who were six months old.
The other couples were Fiona and David Payne and their daughter Lily who was one year old and Stuart and Tara who
had two boys aged three and one. I do not remember Tara and Stuart's surname nor the names of their children.
Katherina and I had booked the holiday for one week and the other two couples had booked for two weeks. We stayed together
in a large villa.
We all arrived at the villa separately.
During the period we stayed at the villa I
remember a gesture made by David Payne.
I do not remember the context of the conversation between David and Gerry,
but I do remember seeing David use his left index finger to rub his nipple, using circular movements, whilst he put his right
index finger into his mouth, touching his tongue. This happened during a meal, at the end of the day in the villa, I do not
remember the time or the date, but we would usually dine between 19.30 and 21.00 every day. I think this happened in the middle
of the holiday.
I remember that when I saw this gesture I immediately thought it to be in very bad taste, independently
of the context of the conversation they were having. We were sitting around a white plastic table in the villa. I don't
know if anyone else saw the gesture, apart from my wife Katherina. After this gesture, we did not notice any others and as
far as I know, the gesture was not repeated.
We never commented on this gesture during the rest of the holiday
and I thought no more about it.
I can describe Dave as a Caucasian male 1.78 m tall, and of a medium complexion.
He had brown hair and used glasses/contact lenses depending on the circumstances.
I can say that Dave was a pleasant
person. I do not remember him having any unusual characteristics.
During the holidays Dave never behaved in an
inappropriate manner with Madeleine or with any of the other children. Dave was popular with the children and I took this
to be because he was a close friend to the family.
I never distrusted Dave. After the holidays there was one occasion
when we were with Kate and Gerry and Fiona and Dave were also present.
That was in a restaurant in Leicester in
2005. I do not remember the name of the restaurant.
We had a pleasant evening, just the three couples without
I do not remember Dave having behaved inappropriately on this occasion. We have not spoken to Dave
or Fiona since December 2005, only due to their being friends of Kate and Gerry, not for any other reason.
last time I saw Kate, Gerry, Madeleine, Sean and Amelie was in March 2007 when they came to our house for the first birthday
celebration of my daughter I*****. On the morning of 4th May Katherina saw the news about Madeleine on television. We were
very shocked and worried given that they were close friends.
It was during the days following the news of the abduction
that we discovered that Fiona and David Payne were also with them in Portugal.
It was at this moment that Katherina
showed concern at the gesture made by Dave in Majorca in 2005. Katherina remembered that when Dave made the gesture he was
referring to Madeleine.
I only remember that Katherina saw the gesture at the time, I had forgotten the episode,
it was never the subject of conversation.
At the time I did not feel the gesture was referring to Madeleine.
It is my wish that the police are aware of my concern with the gesture made by David Payne.

I read carefully the written statements given by David Payne but was not able to
extract any other information besides what is already known.
He declares that he saw Madeleine,
for the last time, at 17H00 on 3/5/07 in the McCann's apartment. Also present there were Kate and Gerry. He did not indicate
the motive for being there or what he was doing. Similarly he does not indicate for how long he stayed.
When asked with whom he was on the afternoon of May 3rd, he declares that this information was already offered
to the police and he cannot remember if anyone else was there.
He does not remember what
he was wearing that afternoon.
He took part in the searches, having carried out most of them
alone. He was at times accompanied by Matthew Oldfield.
He did not partake in the searches
realised on the 4th of May, because, on this day, he spent to majority of time in the police headquarters.
For many of the questions, he does not give a complete answer, affirming simply that he has already given this
information/declaration to the Portuguese police.
I examined again the declarations of Fiona
Payne. In her depositions, she states that she went to the McCann apartment, around 19H00, on the 3rd of May, together with
Kate. She states that 10 minutes later, the husband arrived; it is not clear which husband she refers to, if to Gerry or her

Re: Collection of Information
In the sequence of information
transmitted to this Police force, on this date we went to the residence of Yvonne Warren Martin. The team was composed of
the undersigned and his colleague Carlos Antunes, in conversation with Yvone the following was established:
On May 04, 2007, at around 07H00 she heard about the disappearance of an English girl from Praia da Luz, Lagos, from Sky News
- Having worked for 25 years in the area of child protection, she felt obliged to offer help to her compatriots
and went to Praia da Luz.
– At around 09H00, she met the McCann couple next to the apartment from where
the child had disappeared, accompanied by a third person, a male, who seemed quite familiar to her.
- This third
person of the group appeared to be an intimate (friend) of the family as he was the one who, when the media arrived, began
to explain what was happening and answering questions, thereby saving the couple from this upset. Afterwards, she further
confirmed his closeness to the family when she saw him taking care of the couple's twins, also small children.
- She identified herself and presented her credentials and immediately began talking to the mother of the missing child
as she was visibly upset with the situation.
- During the conversation the mother told her that she did not understand
why a couple had abducted her daughter.
- However, the third individual overheard this conversation and interrupted
Ms. Martin and took the McCann couple away from her.
- This same individual came shortly afterwards to tell her
that the couple did not want to talk to her any further and did not require her help—an action that appeared quite strange
- Meanwhile, she heard comments next to the complex reception that the British Consul was coming to the
site and she decided to wait for this person in order to offer her help.
- During this time, she saw the third
individual two more times. Firstly, when he was accompanying an older woman and the McCann twins, demonstrating in this way,
the trust that the couple had in him by letting him take care of their two children. On the second occasion, he accompanied
what appeared to her to be plain clothed police officers.
--YVONNE describes the third individual as follows:
Aged about 35 years Of about 1,80 metres in height Of normal physical appearance Having short, dark
hair Using graduated glasses of small dimensions with rectangular lenses Having a round face Presenting a scar

– When she was back home, following the case on English television,
she saw the same individual and this time, her initial doubt faded and she concluded that she had seen the face in the course
of her professional activity in child protection, not being able to discern if he was a suspect/arguido or witness
- She clarifies that she is capable of making a photographic identification of the individual, and emphasises that with
the identified photo it is possible to access the database of the British Police and ascertain whether the individual is related
to any crimes involving children

that she has lived in Portugal for seven years on a part-time basis, in other words,for some months of the year she lives
in her home in Sargaçal and for the rest of the year lives in England, where she still works.
past month of May or more precisely on the 04th of May 2007, the witness was in Portugal, enjoying holidays, when at about
07H00 she turned on the television and watched an English news channel (BBC or SKY NEWS) where she saw an appeal to British
citizens on holiday in the Algarve to offer all possible support to a British couple who were on holiday in Praia da Luz and
whose daughter, a child, had disappeared on May 03, 2007.
As she works directly with situations of children at
risk, and as she was very close to Praia da Luz, she went there with the intention of offering her help and support to the
couple, she arrived there at about 09H30.
She clarifies that she did not leave immediately for Praia da Luz as
she still had some things to do at home but left at around 09H00.
At first, she could not locate the exact site
where the family was staying on holiday. Upon seeing a police patrol car which passed close by her, she asked the police if
they could show her the right location. She was accompanied by the patrol car to the apartment from where the child had disappeared
and where the parents were staying.
At the scene, she found a group of three people, two males and one female.
She went over to the group and identified herself.
Two members of that group, a male and a female,
identified themselves as the parents of the missing child—the McCann couple.
The couple were visibly upset,
and the mother was crying intensely.
The third person never identified himself, upon the witness's insistence
the couple replied that he was a close friend of the family.
She adds that this third person appeared familiar
Taking advantage of the information that she had heard on the news, she began questioning the couple about
how often they had checked on the children, obtaining the reply that people would go to see them every hour.
is normal and routine in her service, she asked whether Gerry was the biological father of the missing child, to which he
She clarifies that she asked this question because during the course of her 25 years of service working
with children at risk, it is very normal that when a couple has child and where the father or the mother is not a biological
parent, the biological parent may have a tendency to come and "get" his child.
After having obtained
the verbal response from Gerry, the mother, Kate, questioned what she was doing asking these questions which should be asked
by the police, who were already on the scene in large numbers searching for her daughter, who had been taken by a couple.
At this moment, the witness notices that the couple began to have doubts about her capacity and she immediately showed
them her official documents and credentials issued by the British government to calm them down.
Gerry took her
documents and showed them to the third person and told him that they were authentic and were certified by the police.
At this moment, the witness wishes to clarify that, in England, anyone who works with children, whether a doctor, police
officer or social worker, has to have a proper credentials certified by the police and that this was one of the documents
she showed to the McCanns.
Because she found it strange that Kate told her that her daughter had been taken by
a couple, she tried to separate her from the other two individuals so that she could speak to her with more privacy, suggesting
to Kate that they (Y and K) should enter the apartment, Kate aggressively rejected this idea and told her that they could
speak on the street.
The witness then asked whether anyone from the Medical Centre had been with Kate as she was
very agitated and needed some support, she was told they hadn't.
At this point, Kate told her that her daughter
had disappeared 13 hours ago. It was about 10 in the morning.
Meanwhile a fourth individual came towards the group
and identified himself as a journalist. The witness alerted the couple to the type of statements they should give and that
it would be better for them to keep silent.
At this moment, the third person, who was always near to the couple
and the witness, moved the couple away from her and the three of them talked in whispers for some time.
this, and leaving the couple behind him, he approached the witness and told her that the couple did not want to speak any
more with her, nor with anyone else.
The witness replied to him that if the McCann couple felt the need to talk
to her later, she would be at their total disposal.
As she said earlier, this third person of the group is familiar
to her, and thinks that she may have come across him in the course of her work, as a suspect or witness.

She adds that, after having spoken to the McCann couple, she spoke to the resort manager, and after identifying
herself, asked him whether there had been a break-in in the apartment where the child was, to which he replied no but that
the door was open as were the window blinds, which, according to Kate, should have been closed but were found open.

On 13th June, 2007 at the Portimao DIC, Yvone Warren Martin appeared before me, José Monteiro,
Inspector, in order to proceed with photographic recognition.
When asked, she described the suspect and she was
shown photographs of various individuals who made up the McCann couple holiday group.
Upon visualising the photographs,
she recognised David Anthony Payne, an individual who appeared in several photographs, as being the person she referred to
in her statements and who she supposedly had known on another occasion.
The present document was drawn up and after
being translated by the interpreter, will be signed.

She comes to the process as a witness
and as she does not speak Portuguese she is accompanied by interpreter Filipa Maria da Conceição Silva who will
translate all questions and answers into English.
The witness has given a previous statement to this police force
regarding the facts in question. This took place on 13-06-2007 and led to the inquiry of the statement that was taken. The
witness confirms the complete integrity of that statement, everything was fully reproduced for this file. The witness was
also shown attached page showing the places of work where she carried out her professional activities as Social Services Manager
for Child Protection, having also confirmed that these were the cities where she carried out her professional activities.
She states that in the course of her contact with Madeleine's parents, described in detail in her previous statements,
Kate told her that the child had been taken by a couple. During the meeting they had, the details of which are contained in
her previous statement, she did not have the opportunity to ask in depth about this question nor about any other.
With regards to the individual who was close to Madeleine's parents when she met them, and who was later identified
as David Payne, she reaffirms that the same individual seems familiar, possibly as this same individual intervened in a situation
related to a professional activity of the witness. She clarifies that neither on that occasion, nor now that time has passed,
can she remember concretely the place or the situation in which she may have come to know David Payne, but that she continues
to think that the same individual is familiar to her but cannot state the particular situation.
She adds that
her hypothesis is that she may have come to know him professionally through work, potentially having been colleagues at work
or have worked at the same place but she cannot be certain where she met him as she does not remember
that about two weeks after Madeleine's disappearance, when the police made an appeal for information about a man, carrying
a child, who had been seen in the Luz zone, and whose clothing was described, she wrote an anonymous letter to the British
police, telling them the following: regarding the various details she observed during her contact with the McCanns it is her
opinion that they could be in some way involved in the disappearance of Madeleine.
She first found them aggressive
and their reaction after she showed Madeleine's parents her credentials, also seemed strange to her. Afterwards she was
informed that there were no signs of a break-in in the apartment. Knowing that they are doctors she found it absolutely abnormal
that they left their children alone at home. Associating all of this with her professional experience, which tells her that
in 99.99 % of missing children cases, the parents or other family members are involved, she felt it was her duty to inform
the police of this.
She did this anonymously because she did not want to be bothered by the media. But she also
states that according to what she remembers, when she met with Madeleine's parents, David Payne, who was with them, was
wearing a dark polo shirt, blue or black coloured, cream coloured long trousers, of linen or cotton, and dark shoes (sandal/slipper
type without a back buckle/catch). In her opinion, this clothing matches perfectly with the clothing the Police described
the man (carrying the child) to be wearing at the time. All these coincidences made the witness think that the parents and
their friends could possibly be involved in the disappearance of the child.
She declares that one of her main
aims when she wrote the anonymous letter was for the British police to check the paedophile or child abusers registers and
whether David Payne was on that list.

was suspected of paedophile behaviour.
Twelve days after Maddie disappeared, a couple revealed the strange
behaviour of one of the group's members. Testimonies only reached the Judiciária in January this year
David Payne, one of the McCanns' friends that were on holiday in the Algarve on the 3rd of May last year, when Madeleine
disappeared, was suspected of paedophile behaviour.
The accusations were brought by a couple of friends that spent
their holiday with part of the group in the summer of 2005 – themselves also English doctors. Twelve days after the
British girl disappeared, Katherina and Arul could no longer keep the secret that had bothered them for two years and went
to the police to make a statement. They revealed two conversations between Dave and Gerry, during which both revealed suspicious
behaviour and indiciated sex with minors.
According to what CM was able to establish, the depositions were given
on the 16th of May. But they only entered the process on January 2008 and are included in the 13th volume of the process files.
At that point in time, Kate and Gerry were already arguidos, the rogatory letters had already been issued and the English,
including Dave, showed their reluctance in returning to Portugal.
Katherina made a statement that was eight pages long. She reported holidays in Mallorca
with several English [people], including the McCanns and the Paynes. Two incidents left her with serious doubts about the
friends' behaviour and led her to create suspicions that were never confirmed.
The first one happened on a
night when Gerry and Dave were talking about Maddie. Katherina does not know what they were saying but she remembers that
Dave sucked on his fingers, pushing them into the mouth and pulling them out again, while his other hand traced a circle around
the nipple, with a circular movement over the clothes. "That was done in a provocative manner", recalls Katherina,
who says that it stuck to her memory.
Days later, the scene repeated itself. The doctor saw Dave making the same
gestures again, while he talked about his own daughter. Scared, Katherina said nothing about the incident. But she took special
caution, asking her husband never to let the doctor come close to the bathroom when her daughter was having a bath.
Arul went to the police to tell the same story. Katherina's companion confirmed the gestures that were made by Dave
during the conversation with Gerry but asserted that he wasn't aware that they were talking about Maddie. He did find
the behaviour in extremely bad taste, but didn't see it being repeated.
The incident ended up forgotten in
his memory and it was only the disappearance of Madeleine, who had also been with them on the Mallorca vacation, that revived

Dave and they only met again once, during a dinner that gathered several couples. When Maddie disappeared from the Ocean Club,
Katherina remembered the incident in Mallorca. And she immediately tried to verify whether Dave had again been accompanying
the McCann couple, as the suspicions about his behaviour still stood. In the deposition that was made to the English police,
Katherina says she decided to give a statement when she saw the TV images. Dave was among the same holiday group.

In May. Something went wrong with that group during a holiday: David Payne made revealing gestures concerning behaviour towards
children. Even towards Maddie. We asked for information but it arrived after the 26th of October. They sent the information
without giving it any importance.
What exactly did arrive?
A couple of doctors spent
holidays in Mallorca, in 2005, with David Payne, the McCanns and another couple. The lady says she saw Payne with his finger
in his mouth, making a movement in and out, while rubbing his nipple with the other hand. And he was talking about Maddie,
next to her father. Those statements should have been given a different treatment by the police. It was relevant to access
the information, about doctors, who are just as credible as anyone else.
What else remains unclear concerning
He will be the last one to see Maddie alive after 5.30 p.m., when she leaves the crèche.
He meets Gerry playing tennis and asks him about Kate and the children. Gerry answers that they are in the apartment and he

behaviour that they deemed inappropriate and obscene. The suspicion, which concerned the matter of health care, led to monitoring
when he bathed the children and preventing him from being close to her own daughter. Meanwhile, Payne comes to Portugal this

The doubts are reflected in a statement given to police in Leicestershire,

Her statement then becomes more expressive when it relates to the behaviour of David Payne:
"Possibly around the fourth or fifth day abroad, I remember an incident that stayed recorded in my head. I was seated
between Dave and Gerry who I believe were both speaking about Madeleine. I don't remember the conversation in its entirety,
but it seemed they were discussing a possible scenario. I remember David telling Gerry something like "she", referring
to Madeleine, "would do this".
Judging by the statements, even the doctor was convinced that she was
the topic of conversation. When he mentioned "this", Dave was sucking on one of his fingers, pushing it inside and
outside his mouth, while with the other hand he made a circle around his nipple, with a circulatory movement over his clothes.
This was done in a provocative manner and carried an explicit insinuation in relation to what he was doing and making. I remember
that I was shocked at this, and looked at Gerry, and also at Dave, to gauge their reactions. I looked around as if saying
"did someone else hear that, or was it just me". There was a nervous silence registered in all the conversations
and afterwards, everyone began talking again," said the British doctor.
Later she said: "Besides this,
I remember that Dave did the same thing once again. When I refer to this, I want to clarify that it was during a conversation
in which he was talking about an imaginary situation, though I could not say exactly what about. (...). He put one of his
fingers in his mouth and slide it in and out, and with the other hand, drew a circle around his nipple in a sexually and provocative
way. I believe that he was referring to the way that his daughter would behave or do it. (...) When I heard Dave doing and
making this a second time, I took it more seriously. I remember thinking whether he looked at the girls in a manner different
from me or from the others. I imagined that maybe he had visited Internet sites related to small children. In short, I thought
he was interested in internet child pornography." Attentive to the baths
Katherina made a highly critical assessment of the behaviour that she claims to have observed. And
so became attentive to any contact between Payne and children. "During our holidays I was more attentive at bath time
after hearing Dave saying that. During our vacation in Mallorca, it was the fathers who took care of the children's baths.
I had the tendency to walk close to the bathroom, if Dave was bathing his children. I remember telling Savio (her husband)
to be careful and to be there, in case it was Dave helping to bathe the children and, in particular, to my daughter Ellen.
I was very clear about this, as having heard him disturbed me, and did not trust him to give a bath to Ellen alone,"
said the doctor friend of the McCanns in her statement to police.
"The first time I had knowledge of the terrible
news about Madeleine's disappearance through the radio, my thoughts went immediately to Dave. (...) I watched TV meticulously,
and seeing the coverage of the news, I understood that Dave was there, because I saw him, in the background, on the television
images during the first days after the Madeleine's disappearance," said the witness.
At the same time,
her husband Savio described the behaviour of Dave (the finger making circles around the nipple), considering the gesture inappropriate
and "extremely bad taste, regardless of the context of the conversation." Savio ends his statement by saying: "It
is my wish that the police are aware of my concern about the gesture made by Dave Payne."
True, these statements
and the eventual evaluation of the facts revealed, did not eventually have consequences in the case. Other information was
added to the enigma that was transformed into the disappearance of Madeleine.
David Payne is expected this Friday
in Faro, in a lightning visit to the village of Luz. He comes with a team from Channel 4, who are making a documentary about
Maddie. The same team that were already in that place a week ago, that time accompanied by Gerry McCann. Payne will leave
the day after flying from England.

The claim of Gonçalo Amaral refers to the British couple, (doctors Katherina
and Arul) who denounced David Payne. During that past holiday with the McCann's and Payne's in Mallorca, summer 2005,
that British doctor retained an impression and never forgot what she saw one night when Gerry and David were talking about
Maddie. David sucked on his finger, pushing it into and out of his mouth, while with the other hand made circles around his
nipple. Days later, the doctor said, she returned to see Dave do the same gestures when speaking about his own daughter. Katherina
decided to take special care with her own daughter and asked her husband to ensure that her daughter was never left alone
with Payne when she was taking a bath. Kaherina said she had associated the gestures with someone who likes to see pornography.
"I remember thinking if he would look at girls in a different way," she concluded. Twelve days after Maddie disappeared
(16 May), Katherina and Arul went to the police to reveal the two conversations with Dave and Gerry, which first showed suspicious
behaviour and suggested sex with minors. Katherina provided an eight-page statement. She described the holiday in Mallorca
with McCann and Payne. Katherina's partner confirmed the gestures made by Dave during the conversation with Gerry, but
said he did not realise that they were talking about Maddie. He also believed that the behaviour was of extremely
bad taste. The statements were provided on May 16, 2007, but had no input into the process until January 2008 (Volume XIII).
By then, the rogatory letters had already been sent. David Payne, the same
Tvmais has already reported that David Payne is the same one that the PJ did not see testify in England. He is the only
one whose statements for the famous rogatory letters, that the PJ sent to England, were remade because of a malfunction in
David Payne was one of the friends dining with the McCanns on the night of the disappearance of
the girl at the Ocean Club. He is the man that tvmais had already confirmed had been in apartment 5A of the resort (home of
the McCanns) about 19:00 that afternoon of May 3, 2007, shortly before, therefore, the time that the girl was reported as
missing. Up to the closure of this edition, we failed to confirm whether someone from the Attorney General's Office saw
the documentary. Although the rest had already been informed by tvmais throughout the almost two years that have elapsed since
the disappearance of Madeleine McCann, a British child of 4-years-old, in the Algarve. We even showed the reported information
of the declarations about Payne to the British police. It was the phrase Gonçalo Amaral on TVI's documentary: "It
can be said with all certainty that Madeleine McCann was not abducted." McCanns
already control the fortune
The fund created just nine days after the disappearance of Maddie (a
fund whose only goal was to raise funds to find the girl, accumulating millions of euros) has a new director: Gerald McCann,
the very father of Madeleine McCann. Discreetly, they had already entered Peter Hubner, John McCann, Edward Smethurst, Doug
Skehan, Jon Corner and other friends of the McCanns. This special status of the fund means that detailed accounts on how the
money is spent do not need to be submitted. The McCanns house and other expenses are not reflected as being paid by the fund,
although of the accounts presented, what is clear, is that barely 13% of the money was spent on investigations to "find

hair, errr... in a bob, she was quite a petite, errr... child and, you know, she was very bubbly, very, errr... you know,
she was a very good child to, to interact with. She was very bright, you could have a lot of fun with Madeleine, errr... and,
you know, she, she was, you know, Kate and Gerry's, you know, pride and joy. They'd had a lot of trouble conceiving,
you know, with IVF and everything and, you know, Madeleine was their miracle. She was obviously very unique with the fact
that she'd got the, you know, the iris defect, errr... but, you know, she was certainly a happy go lucky child, you know,
she was, she would interact with the other children very well, as I said on the other, earlier recording, you know, she played
very happily with Lily and, you know, indeed the other children. She was, you know, very... she is a very beautiful child

Suspicions about Payne were never investigated, 27 April 2009
The suspicions against medic David Payne, one of the McCanns' English friends, who was in Praia da Luz on the 3rd of
May 2007, when Madeleine disappeared, were never investigated. Meanwhile, the doctor moved house and doesn't live in the same
London area anymore. He was expected to return to Praia da Luz over the last few days, to record the documentary that is being
prepared in England, but he ended up cancelling the trip. It is unknown if an actor will play his part in the reconstruction
that is promoted by Kate and Gerry.
"On the day that Madeleine disappeared, his behaviour was very strange. He tried to sit in during the interrogations
of Kate and Gerry, and he seemed very upset", a member of staff at the Ocean Club who assisted the searches during the first
few hours, told CM.
David Payne was cited in the process twice, as having strange behaviour towards children. The first case took place in
the initial hours that followed the child's disappearance, when a social services worker from England, who happened to be
on holidays in Lagos, stated that she recognised Payne from a situation that she had investigated and which was related to
child neglect or sexual abuse.
Later, an English couple told the police that a year before they had been on holidays with the McCanns and with the Payne
couple, and that back then, the doctor had had a conversation with Gerry, which they witnessed, that indicated child abuse.
Payne used to bathe the children and since that day, that English couple, both doctors as well, prevented him from getting
close to their daughter.
Payne wasn't questioned by the police because he returned to England in the meantime.
The McCann couple then refused to take part in the reconstruction of the night when Maddie disappeared, thus making it
impossible for the suspicions against Payne to be proved or dismissed. At that time, Gerry and Kate were already arguidos
over the concealment of the cadaver and neglect towards their children.

It's a pleasant Sunday morning in Athens and the temperature is approaching 30˚C. I'm
sipping a Mythos beer in the shade of an umbrella whilst taking in the view of the Acropolis, satisfied with the new award
- Fellow of the European board of urology (FEBU). Not bad considering less than 48 hours ago I was leaving the rainy shores
So what madness drove me to sit yet more exams? I had always been impressed with the EAU's approach
to trainees and as a junior member I had enrolled on the European Residents Education Programme (EUREP) in Prague. This is
essentially a revision course with the option for final year trainees to sit the EBU MCQ paper at the end of the week. Those
who pass the exam can proceed to sit the EBU oral exam held at a later date. On the course I met several UK trainees who were
using the week to prepare for the UK FRCS urology exam. This seemed a sensible strategy to sit both the European and English
exams in quick succession whilst being at your most knowledgeable.
I eventually sat the EBU written exam in London
in November 2008 along with 17 other hopeful candidates. In total, 227 trainees across Europe took the exam at several venues.
The paper consisted of 150 MCQ's, which had to be completed within 2 1/2 hours. The paper was very fair with the questions
being mainly clinically orientated and applicable to UK practice.
Two weeks later I was notified that I had passed
the exam and was provided with a breakdown of marks for each urology sub-speciality. This latter feature was helpful in directing
subsequent revision for the FRCS urology written paper that was conveniently held six weeks later, which I also passed. So
far so good...
Next up were the oral examinations with the FRCS in May and the EBU equivalent in June. The FRCS
viva involved answering questions on 16 different scenarios testing all of the urology sub-specialities. Although re-energised
by the relief of passing the FRCS vivas, I did question the logic of rushing off two weeks later to sit another viva abroad.
However, on landing in Athens on a Friday night with the warm breeze that greets you on arrival, the ordeal becomes
more like an adventure. The vivas were held on the Saturday in a hotel not far from the city centre. Unlike the endless vivas
for the FRCS, the EBU oral consists of three structured scenarios lasting just under an hour. My first viva covered paediatrics,
the next penile cancer, with the final clinical based problem beginning with a BPH scenario which took a cheeky change in
direction, turning into the management of bladder cancer.
The examiners were very friendly and encouraging throughout
but expected knowledge to be backed up with reference to the 2009 EAU guidelines. Once the vivas are finished, the award ceremony
was held later on that evening. The names of those who have passed are called out and the FEBU diploma is awarded to the applause
of the other trainees. Very few people fail outright, with borderline candidates getting another opportunity to sit a pass
fail viva that evening.
My overall impression of the EBU exam is a very positive one. It's reasonably priced,
well organised with sensible, and clinically based questions giving trainees from all over Europe the chance to test their
clinical abilities. To date, 188 urologists in the UK have passed the diploma – the total stands at 2617. Although FEBU
is not currently recognised as a formal qualification, the number of UK trainees sitting the exam is likely to continue to

McCanns defend their action against detective, 21 January 2010
Gerry McCann defended his legal action against a detective who led the investigation into his daughter's disappearence,
saying his book had damaged the search for Madeleine. He spoke to reporters as he left a court in Lisbon on the second day
of a hearing at which former police chief Gonçalo Amaral is attempting to overturn a ban on his book, which questions
the McCanns' account of what happened to Madeleine.
Gerry flew home after the second day of the trial and Kate
was joined by Fiona Payne, a member of the so-called Tapas seven group of friends.
However there have been worrying
reports regarding her husband, David, who was also amongst the group. Dr. Katherine Zacharias Gaspar told Leicestershire Police
on May, 16, 2007, that she and her husband were friends of the McCanns and went on holiday with them and the Paynes in September
2005. During this holiday an incident stuck in her mind.
"I was sitting between Gerry and David and I think
both were talking about Madeleine (...). I remember David saying something to Gerry about "she", meaning Madeleine
'would do this'. While he mentioned the word 'this', David was doing the action of sucking one of his fingers,
pushing it in and out of his mouth, while with his other hand he was doing a circle around his nipple (...). I remember being
shocked by that."
Gerry also told reporters outside the court that there is 'absolutely no evidence'
that Maddie is dead, after the testimonies of three members of the Portuguese Police expressed their suspicions of her death
during the hearing.
